Terms and Conditions – Moïshan

1. Applicability and company details
These terms and conditions apply to all group classes, workshops, and other activities organized by Moïshan. By booking a class or activity, you agree to these terms and conditions.

2. Booking and payment
A reservation is final once the booking is completed and payment has been received.
Payment is made in advance via the booking system.
All prices are stated in euros.
3. Right of withdrawal
For agreements concluded at a distance (such as a booking made via the booking system), Dutch law generally grants consumers a 14-day right of withdrawal. However, for services to be performed on a specific date or within a specific period – such as a yoga class or workshop at a fixed time – this right of withdrawal is excluded by law (Article 6:230p(d) of the Dutch Civil Code). This means a booked class cannot be withdrawn under this right; cancellations are governed by the terms set out in Article 4.
4. Cancellation
A reservation can be cancelled free of charge up to 24 hours before the start of the class.
In case of cancellation within 24 hours before the start, the full price of the class will be charged.
For a class card (strippenkaart), one credit will be deducted.
In case of absence without cancellation (no-show), one credit will likewise be forfeited, or no refund will be given.
5. Arriving late
To ensure a calm and safe start to the class, all classes begin at the indicated time. If you arrive after the class has started, the instructor may decide not to admit you. In that case, there is no right to a refund, a replacement class, or reimbursement.
6. Validity of yoga classes
A single yoga class is valid for 30 days from the date of purchase.
A yoga class card (strippenkaart) is valid for 30 days from the date of purchase.
After the validity period expires, any unused classes automatically lapse.
Unused classes cannot be exchanged for money, extended, or transferred to third parties, unless Moïshan decides otherwise in writing.
7. Cancellation or modification by Moïshan
Moïshan reserves the right to cancel or modify a class when there is reason to do so, for example in the event of the instructor’s illness, unforeseen circumstances, or insufficient participants. When a class is cancelled by Moïshan, the participant will receive a replacement credit or a refund of the amount paid for the class. Any other or additional form of compensation is excluded, subject to Article 9.
8. Health and personal responsibility
Participation in the classes is entirely at your own risk. The participant is responsible for assessing whether participation is physically appropriate. Injuries, pregnancy, or other medical conditions must be reported to the instructor prior to the class. In case of doubt, it is advised to first consult a doctor or healthcare provider.
9. Liability
Moïshan is not liable for injury, damage, loss, or theft of personal property during or around the classes, unless there is intent or gross negligence.
10. Photos and videos
During some classes or events, photos or videos may be taken for Moïshan’s communications, for example for the website or social media. Whenever this happens, we will always announce it in advance of the class. If you would prefer not to be recognizable in any images, you can always let the instructor know. We will, of course, respect this choice.
11. Personal data
Personal data is used exclusively for processing bookings, communication regarding the classes, and improving our services. We handle your data with care and do not share it with third parties, unless we are legally required to do so. For more information on the processing of your personal data, your rights, and retention periods, please refer to our privacy policy.
12. Respectful environment
Moïshan is a place where we create a safe, open, and respectful environment together. We ask every participant to treat the space, the instructor, and each other with care, so that everyone feels welcome and free to participate.
13. Changes to these terms and conditions
Moïshan reserves the right to amend or supplement these terms and conditions. The most current version is always available via the website and/or the booking system. By using our services, you agree to the terms and conditions in effect at that time.
14. Governing law and disputes
Dutch law applies to all agreements and these terms and conditions. Disputes will, where possible, be resolved through mutual consultation. If the parties cannot reach a resolution, the competent court in the district where Moïshan is established has jurisdiction, insofar as mandatory law does not provide otherwise.
